{"id":196237,"date":"2019-04-05T21:42:26","date_gmt":"2019-04-06T01:42:26","guid":{"rendered":"https:\/\/oncubanews.com\/en\/?p=196237"},"modified":"2019-04-05T21:42:26","modified_gmt":"2019-04-06T01:42:26","slug":"u-s-suspends-for-two-more-weeks-full-application-of-title-iii-of-helms-burton-act","status":"publish","type":"post","link":"https:\/\/oncubanews.com\/en\/cuba-usa\/u-s-suspends-for-two-more-weeks-full-application-of-title-iii-of-helms-burton-act\/","title":{"rendered":"U.S. suspends for two more weeks full application of Title III of Helms-Burton Act"},"content":{"rendered":"<p><span style=\"font-weight: 400;\">U.S. Secretary of State Mike Pompeo <\/span><a href=\"https:\/\/www.state.gov\/r\/pa\/prs\/ps\/2019\/04\/290882.htm\" target=\"_blank\" rel=\"noopener noreferrer\"><span style=\"font-weight: 400;\">announced<\/span><\/a><span style=\"font-weight: 400;\"> on Wednesday that he would suspend for two more weeks <\/span><a href=\"https:\/\/oncubanews.com\/tag\/helms-burton\/\" target=\"_blank\" rel=\"noopener noreferrer\"><span style=\"font-weight: 400;\">Title III of the Helms-Burton Act <\/span><\/a><span style=\"font-weight: 400;\">, which would strengthen the embargo on Cuba and would allow making claims before U.S. courts for properties on the island that were expropriated after the Cuban Revolution.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">In a <\/span><a href=\"https:\/\/www.state.gov\/r\/pa\/prs\/ps\/2019\/04\/290882.htm\" target=\"_blank\" rel=\"noopener noreferrer\"><span style=\"font-weight: 400;\">press release<\/span><\/a><span style=\"font-weight: 400;\">, Pompeo announced that he will prevent the coming into force of this legal measure for two more weeks, from April 18 (date on which the current suspension expires) until May 1, but will continue allowing lawsuits against <\/span><a href=\"https:\/\/www.state.gov\/e\/eb\/tfs\/spi\/cuba\/cubarestrictedlist\/290163.htm\" target=\"_blank\" rel=\"noopener noreferrer\"><span style=\"font-weight: 400;\">more than 200 Cuban companies<\/span><\/a><span style=\"font-weight: 400;\"> that appear on a &#8220;<\/span><a href=\"https:\/\/www.state.gov\/e\/eb\/tfs\/spi\/cuba\/cubarestrictedlist\/290163.htm\" target=\"_blank\" rel=\"noopener noreferrer\"><span style=\"font-weight: 400;\">black list<\/span><\/a><span style=\"font-weight: 400;\">&#8221; clip: rect(1px, 1px, 1px, 1px);\" title=\"\u00abEEUU a\u00f1ade otras cinco empresas cubanas a su lista negra\u00bb \u2014 OnCubaNews\" src=\"https:\/\/oncubanews.com\/cuba-ee-uu\/eeuu-anade-otras-cinco-empresas-cubanas-a-su-lista-negra\/embed\/#?secret=AouQuMWxqf#?secret=vRZI97TA5I\" data-secret=\"vRZI97TA5I\" width=\"500\" height=\"282\" frameborder=\"0\" marginwidth=\"0\" marginheight=\"0\" scrolling=\"no\"><\/iframe><\/p>\n<p><span style=\"font-weight: 400;\">Since its creation in 1996, Title III of the Helms-Burton Act has been suspended by all U.S. administrations every six months, but Donald Trump\u2019s presidency has increasingly shortened those periods: first it annulled it for 45 days, then for a month and now for only two weeks.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">The State Department does not explain why Pompeo has decided to reduce the suspension period, although some analysts interpret it as a warning to Havana.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">In this regard, the State Department stated that it continues to examine the conditions of human rights in Cuba, including the current repression against the rights of the Cuban people to freedom of expression and assembly.<\/span><\/p>\n<p>https:\/\/oncubanews.com\/cuba-ee-uu\/expertos-la-aplicacion-del-titulo-iii-depende-solo-de-los-tribunales-de-eeuu\/<\/p>\n<p><span style=\"font-weight: 400;\">It added that the Department is also supervising Cuba\u2019s military, security and intelligence support to Nicol\u00e1s Maduro, responsible for repression, violence and the humanitarian crisis in Venezuela.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Title III of the Helms-Burton Act was created to allow Americans, including nationalized Cubans, to sue before U.S. courts the companies that are supposedly benefiting from properties in Cuba that were theirs 60 years ago, before the Revolution.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">When that legislation was approved 22 years ago, the European bloc and other countries with business interests on the island were fiercely opposed to it because they feared that their companies would be sued in the U.S.; and this is the reason why the European Union (EU) denounced Washington before the World Trade Organization (WTO).<\/span><\/p>\n<p><span style=\"font-weight: 400;\">The litigation concluded with the U.S. commitment to maintain Title III suspended in exchange for the withdrawal of the complaint.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">So far, the United States has fulfilled its commitment, but for the first time in history, the Trump government established in March that Cuban-Americans could sue the 200 Cuban companies included in the so-called &#8220;<\/span><a href=\"https:\/\/www.state.gov\/e\/eb\/tfs\/spi\/cuba\/cubarestrictedlist\/290163.htm\" target=\"_blank\" rel=\"noopener noreferrer\"><span style=\"font-weight: 400;\">list of restrictions on Cuba<\/span><\/a><span style=\"font-weight: 400;\">,&#8221;
