{"id":200540,"date":"2019-06-13T19:40:04","date_gmt":"2019-06-13T23:40:04","guid":{"rendered":"https:\/\/oncubanews.com\/en\/?p=200540"},"modified":"2019-06-13T19:44:40","modified_gmt":"2019-06-13T23:44:40","slug":"lawsuit-filed-in-spain-against-melia-under-helms-burton-act","status":"publish","type":"post","link":"https:\/\/oncubanews.com\/en\/world\/europe\/lawsuit-filed-in-spain-against-melia-under-helms-burton-act\/","title":{"rendered":"Lawsuit filed in Spain against Meli\u00e1 under Helms-Burton Act"},"content":{"rendered":"<p><span style=\"font-weight: 400;\">The descendants of Spanish businessman Rafael Lucas S\u00e1nchez Hill have filed a lawsuit against the Meli\u00e1 hotel chain for the exploitation of two hotels built on the land of their former sugar mills in Cuba, the Spanish digital portal <\/span><em><a href=\"https:\/\/www.elconfidencial.com\/empresas\/2019-06-10\/sanchez-hill-demanda-melia-hoteles-helms-burton_2061326\/\" target=\"_blank\" rel=\"noopener noreferrer\"><span style=\"font-weight: 400;\">El Confidencial<\/span><\/a><\/em><span style=\"font-weight: 400;\"> reported.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">The hotels in question, <\/span><a href=\"http:\/\/www.meliacuba.com\/cuba-hotels\/hotel-paradisus-riodeoro\" target=\"_blank\" rel=\"noopener noreferrer\"><span style=\"font-weight: 400;\">Paradisus Rio de Oro<\/span><\/a><span style=\"font-weight: 400;\">\u00a0and <\/span><a href=\"http:\/\/www.meliacuba.com\/cuba-hotels\/hotel-sol-riodelunaymares\" target=\"_blank\" rel=\"noopener noreferrer\"><span style=\"font-weight: 400;\">Sol Rio de Luna y Mares, <\/span><\/a><span style=\"font-weight: 400;\">are both located in the province of Holgu\u00edn, on a 485.6-square-kilometer plot of land in what was the <\/span><a href=\"https:\/\/lospueblosdeoriente.wordpress.com\/tag\/don-rafael-lucas-sanchez-hill\/\" target=\"_blank\" rel=\"noopener noreferrer\"><span style=\"font-weight: 400;\">Santa Luc\u00eda sugar mill<\/span><\/a><span style=\"font-weight: 400;\">.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">It isn\u2019t clear to what extent a lawsuit filed in Spain may have value in the United States, which is where the <\/span><a href=\"https:\/\/www.treasury.gov\/resource-center\/sanctions\/documents\/libertad.pdf\" target=\"_blank\" rel=\"noopener noreferrer\"><span style=\"font-weight: 400;\">Helms-Burton Act<\/span><\/a><span style=\"font-weight: 400;\"> is only valid. Moreover, European legislation has rejected the extraterritorial nature of the aforementioned law and the Spanish authorities <\/span><a href=\"https:\/\/oncubanews.com\/cuba-ee-uu\/gobierno-de-espana-ratifica-que-apoyara-a-empresas-espanolas-ante-la-helms-burton\/\" target=\"_blank\" rel=\"noopener noreferrer\"><span style=\"font-weight: 400;\">have emphasized their defense<\/span><\/a><span style=\"font-weight: 400;\"> of Spanish investments in Cuba.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">The S\u00e1nchez Hill family, of Cuban origin, is claiming compensation for 10 million euros for the use of the hotel facilities, which belong to the Cuban company Gaviota, under military administration and which is on a list of companies sanctioned by the U.S. authorities. Meli\u00e1 is only responsible for the management of the facilities.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">&#8220;Specifically, the family is filing a lawsuit in a court in Palma de Mallorca, Meli\u00e1&#8217;s headquarters, for the company to compensate them with an amount equivalent to the benefits they have obtained from these hotels during the last five years.
