But unlike the countries of the region, these can be done without a judge order.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">The decree-law signed by President <\/span><a href=\"https:\/\/oncubanews.com\/tag\/miguel-diaz-canel\/\" target=\"_blank\" rel=\"noopener noreferrer\"><span style=\"font-weight: 400;\">Miguel D\u00edaz-Canel<\/span><\/a><span style=\"font-weight: 400;\"> also allows the legal figures of \u201cundercover agent\u201d and \u201ceffective collaborator,\u201d who will be exempt from criminal responsibility, and also includes \u201csurveillance delivery.\u201d<\/span><\/p>\n<p><span style=\"font-weight: 400;\">As published by the <\/span><em><a href=\"https:\/\/www.gacetaoficial.gob.cu\/pdf\/GOC-2019-EX27.pdf\" target=\"_blank\" rel=\"noopener noreferrer\"><span style=\"font-weight: 400;\">Gaceta Oficial<\/span><\/a><\/em><span style=\"font-weight: 400;\">, the law seeks to regulate \u201cspecial investigative techniques\u201d and \u201cstrengthen the domestic criminal system&#8230;with the aim of increasing effectiveness in crime prevention and confrontation,\u201d especially money laundering and terrorism.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Under the legislation, undercover investigations are operations carried out by agents trained by the Ministry of Interior, the effective collaborator is a defendant who offers information to prevent a crime from being committed and obtains clemency for it and the surveillance delivery consists of allowing suspicious merchandise to be moved but with follow-up.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Meanwhile, electronic surveillance ranges from listening, voice recording, tracking, taking pictures and filming, as well as the interception of communications of any kind and access to computerized systems.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">To make effective the use of these techniques, the police must request authorization from the prosecutor. If it is a prosecutor who requires them, he\/she must have the permission of the Attorney General of the Republic.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">\u201cThe problem is that the same party that accuses you and that upholds that accusation is the one who decides whether or not to apply these techniques,\u201d attorney Raudiel Pe\u00f1a told The Associated Press. \u201cFrom now on an instructor and a prosecutor can spy on you both electronically and in any other way.\u201d<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Pe\u00f1a added that \u201cthis creates legal uncertainty.
