{"id":233078,"date":"2021-01-14T10:17:02","date_gmt":"2021-01-14T15:17:02","guid":{"rendered":"https:\/\/oncubanews.com\/en\/?p=233078"},"modified":"2021-01-14T10:17:02","modified_gmt":"2021-01-14T15:17:02","slug":"lawsuit-against-melia-for-exploiting-land-in-cuba-expanded-against-cuban-state","status":"publish","type":"post","link":"https:\/\/oncubanews.com\/en\/cuba\/lawsuit-against-melia-for-exploiting-land-in-cuba-expanded-against-cuban-state\/","title":{"rendered":"Lawsuit against Meli\u00e1 for exploiting land in Cuba expanded against Cuban state"},"content":{"rendered":"<p><span style=\"font-weight: 400;\">The head of the Court of First Instance number 24 of Palma de Mallorca, Spain, admitted the extension of the lawsuit of Central Santa Luc\u00eda against the Republic of Cuba and the Cuban company Gaviota S.A., in the procedure against <\/span><a href=\"https:\/\/oncubanews.com\/cuba\/economia\/turismo\/melia-confia-en-recuperacion-del-turismo-en-cuba\/\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">Meli\u00e1 Hotels International<\/span><\/a><span style=\"font-weight: 400;\"> for the exploitation of some land on the island.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">The judge informed of the existence of the procedure to the Spanish Ministry of Foreign Affairs and Cooperation for them to issue a report, as provided for in the Law of International Legal Cooperation in Civil Matters, in accordance with the information provided by the Supreme Court of Justice of the Balearic Islands in a statement.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">On the other hand, the Court, ex officio appreciating a possible lack of jurisdiction and international competence to hear the case\u2015now also directed against Cuba\u2015has referred the parties in person and the Public Prosecutor to allege what is convenient.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">The expansion of the lawsuit occurs after the judge issued an order in which she agreed to the existence of a passive joint litigation and required the plaintiff to expand the claim against the State of Cuba and Gaviota S.A.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">In this resolution prior to the extension, the magistrate refers to the jurisprudence of the Supreme Court in relation to unjust enrichment.<\/span><\/p>\n<blockquote class=\"wp-embedded-content\" data-secret=\"ILI1rUvsDG\"><p><a href=\"https:\/\/oncubanews.com\/mundo\/europa\/espana-tribunal-ordena-que-haya-sentencia-en-demanda-contra-melia-por-hoteles-en-cuba\/\">Espa\u00f1a: Tribunal ordena que haya sentencia en demanda contra Meli\u00e0 por hoteles en Cuba<\/a><\/p><\/blockquote>\n<p><iframe loading=\"lazy\" class=\"wp-embedded-content\" sandbox=\"allow-scripts\" security=\"restricted\" style=\"position: absolute; clip: rect(1px, 1px, 1px, 1px);\" title=\"\u00abEspa\u00f1a: Tribunal ordena que haya sentencia en demanda contra Meli\u00e0 por hoteles en Cuba\u00bb \u2014 OnCubaNews\" src=\"https:\/\/oncubanews.com\/mundo\/europa\/espana-tribunal-ordena-que-haya-sentencia-en-demanda-contra-melia-por-hoteles-en-cuba\/embed\/#?secret=a5mmkmTpCj#?secret=ILI1rUvsDG\" data-secret=\"ILI1rUvsDG\" width=\"500\" height=\"282\" frameborder=\"0\" marginwidth=\"0\" marginheight=\"0\" scrolling=\"no\"><\/iframe><\/p>\n<p><span style=\"font-weight: 400;\">\u201cA basic condition for the action brought by Central Santa Luc\u00eda to succeed is the prior declaration of the illegality of the property title that the State of Cuba holds over the Playa Esmeralda land,\u201d she pointed out. Therefore, only the illegality of this title could cause the consideration of the benefits that Meli\u00e1 obtains from the exploitation of these lands as constituting an unjust or causeless enrichment.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">On the other hand, the judge argues that the exception of lack of necessary passive consortium litigation raised by Meli\u00e1 must be upheld. According to the resolution, it is contrary to the Civil Procedure Law \u201cto resolve this lawsuit without calling to the procedure the owner of the property right to be challenged, that is, the State of Cuba.\u201d<\/span><\/p>\n<p><span style=\"font-weight: 400;\">In the order, the judge concludes that the resolution of the lawsuit presented by Central Santa Luc\u00eda \u201cis evident that it will directly affect the interests of the State of Cuba and the company Gaviota S.A., also owned by Cuba, as the current owner of the land of Playa Esmeralda.\u201d<\/span><\/p>\n<p><span style=\"font-weight: 400;\">According to the decision, the plaintiff bases its action on the attribution of a real right over the Playa Esmeralda land \u201cwhich is contradictory and totally incompatible with the title of ownership that Cuba holds over said land.\u201d In addition, the plaintiff also seeks a declaration of illegality of the aforementioned title.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">For all these reasons, the judge ruled in her resolution that the processing of the procedure \u201ccannot continue without Cuba and Gaviota S.A. being called as defendants,\u201d and she considers the exception of lack of necessary passive consortium litigation raised by Meli\u00e1.
