{"id":236577,"date":"2021-03-24T12:16:37","date_gmt":"2021-03-24T16:16:37","guid":{"rendered":"https:\/\/oncubanews.com\/en\/?p=236577"},"modified":"2021-03-24T12:16:37","modified_gmt":"2021-03-24T16:16:37","slug":"cuba-makes-headway-in-code-that-will-address-same-sex-marriage","status":"publish","type":"post","link":"https:\/\/oncubanews.com\/en\/cuba\/cuba-makes-headway-in-code-that-will-address-same-sex-marriage\/","title":{"rendered":"Cuba makes headway in Code that will address same-sex marriage"},"content":{"rendered":"<p><span style=\"font-weight: 400;\">The Council of State of Cuba appointed those in charge of drawing up the draft of the new Family Code, long-awaited legislation that provides for the inclusion of <\/span><a href=\"https:\/\/oncubanews.com\/en\/tag\/egalitarian-marriage-in-cuba\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">same-sex marriage<\/span><\/a><span style=\"font-weight: 400;\"> and which will be submitted to a referendum.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">The members of the commission that will prepare the proposal for presentation to the Cuban Legislature are deputies, representatives of government and social organizations, specialists and professors expert in the field, the <\/span><a href=\"https:\/\/oncubanews.com\/en\/tag\/cuban-national-assembly\/\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">National Assembly of People\u2019s Power<\/span><\/a><span style=\"font-weight: 400;\"> reported on Tuesday.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">The legislative schedule stipulates that the first draft of the Family Code would be presented in March of this year, to then begin the process of convoking the referendum that will decide its approval.<\/span><\/p>\n<blockquote class=\"twitter-tweet\" data-width=\"500\" data-dnt=\"true\">\n<p lang=\"es\" dir=\"ltr\"><a href=\"https:\/\/twitter.com\/hashtag\/Cuba?src=hash&amp;ref_src=twsrc%5Etfw\">#Cuba<\/a> | En cumplimiento del Cronograma Legislativo, el Consejo de Estado aprob\u00f3 la propuesta de integrantes de la Comisi\u00f3n que presentar\u00e1 el anteproyecto del C\u00f3digo de las Familias a la <a href=\"https:\/\/twitter.com\/AsambleaCuba?ref_src=twsrc%5Etfw\">@AsambleaCuba<\/a>, de conformidad con la Disposici\u00f3n Transitoria Decimoprimera de la Constituci\u00f3n. <a href=\"https:\/\/t.co\/ocIfuBGrxu\">pic.twitter.com\/ocIfuBGrxu<\/a><\/p>\n<p>&mdash; Asamblea Nacional Cuba (@AsambleaCuba) <a href=\"https:\/\/twitter.com\/AsambleaCuba\/status\/1374422392827637774?ref_src=twsrc%5Etfw\">March 23, 2021<\/a><\/p><\/blockquote>\n<p><script async src=\"https:\/\/platform.twitter.com\/widgets.js\" charset=\"utf-8\"><\/script><\/p>\n<p><span style=\"font-weight: 400;\">The possible approval of same-sex marriage in Cuba came to the fore in 2018 during the constitutional reform process that culminated in the promulgation of a new <\/span><a href=\"https:\/\/oncubanews.com\/en\/tag\/cuban-constitution\/\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">Magna Carta<\/span><\/a><span style=\"font-weight: 400;\"> in 2019. The old one, in force since 1976, defined marriage as the union \u201cbetween a man and a woman,\u201d and in the initial draft of the new Constitution, it was proposed to change those terms to \u201cunion between two persons with legal capacity to do so,\u201d which de facto opened the doors to same-sex marriage.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">The issue provoked heated discussions in the debates of the draft Constitution and confronted groups opposed to LGTBI activism and the faithful of various religious denominations, especially from the Catholic and Evangelical churches, which have an increasing presence on the island.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Finally, the Constitutional Reform Commission\u2014headed by the former president and leader of the Communist Party of Cuba, Ra\u00fal Castro\u2014chose to exclude a precise definition of marriage from the new Magna Carta and postponed the debate until the Family Code was updated. This shift sought to ensure majority support for the new Constitution, but caused discomfort among defenders of LGTBI rights, who saw one of the main demands of this community postponed.<\/span><\/p>\n<blockquote class=\"wp-embedded-content\" data-secret=\"Tso7saMRZt\"><p><a href=\"https:\/\/oncubanews.com\/en\/cuba\/mom-mommy-and-paulo\/\">Mom, Mommy, and Paulo<\/a><\/p><\/blockquote>\n<p><iframe loading=\"lazy\" class=\"wp-embedded-content\" sandbox=\"allow-scripts\" security=\"restricted\" style=\"position: absolute; clip: rect(1px, 1px, 1px, 1px);\" title=\"&#8220;Mom, Mommy, and Paulo&#8221; &#8212; OnCubaNews English\" src=\"https:\/\/oncubanews.com\/en\/cuba\/mom-mommy-and-paulo\/embed\/#?secret=G7qJFsCKuw#?secret=Tso7saMRZt\" data-secret=\"Tso7saMRZt\" width=\"500\" height=\"282\" frameborder=\"0\" marginwidth=\"0\" marginheight=\"0\" scrolling=\"no\"><\/iframe><\/p>\n<p><span style=\"font-weight: 400;\">In addition, the new Family Code will be the only one that will go to a referendum among the 70 legal norms updated with the new Magna Carta. Cuban deputies will modify and approve 39 laws and 31 decree-laws in a schedule that runs until 2022.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Another of the most demanded issues in recent years by independent civil society groups, the animal welfare policy, became a reality last February with <\/span><a href=\"https:\/\/oncubanews.com\/en\/cuba\/decree-law-on-animal-welfare-approved-in-cuba\/\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">a new decree-law<\/span><\/a><span
