{"id":242733,"date":"2021-08-21T04:00:50","date_gmt":"2021-08-21T08:00:50","guid":{"rendered":"https:\/\/oncubanews.com\/en\/?p=242733"},"modified":"2021-08-20T17:58:43","modified_gmt":"2021-08-20T21:58:43","slug":"cuban-government-unveils-controversial-cybersecurity-regulation","status":"publish","type":"post","link":"https:\/\/oncubanews.com\/en\/cuba\/cuban-government-unveils-controversial-cybersecurity-regulation\/","title":{"rendered":"Cuban government unveils controversial cybersecurity regulation"},"content":{"rendered":"<p><span style=\"font-weight: 400;\">The Cuban government released this Tuesday a new and controversial cybersecurity regulation, which typifies possible \u201cincidents\u201d in this area and defines their level of danger, as part of a package of regulations on Telecommunications on the island.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Resolution 105 \u201cNational Action Model for responding to cybersecurity incidents,\u201d published in the <\/span><a href=\"https:\/\/www.gacetaoficial.gob.cu\/sites\/default\/files\/goc-2021-o92.pdf\" target=\"_blank\" rel=\"noopener\"><i><span style=\"font-weight: 400;\">Gaceta Oficial<\/span><\/i><span style=\"font-weight: 400;\"> No. 92<\/span><\/a><span style=\"font-weight: 400;\">, comes one month after last July\u2019s anti-government protests \u2014 articulated and disseminated largely through social networks \u2014, which has generated criticism and suspicion about it.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">However, the official Cubadebate website <\/span><a href=\"http:\/\/www.cubadebate.cu\/noticias\/2021\/08\/17\/cuba-actualiza-marco-juridico-en-materia-de-telecomunicaciones-y-tipifica-incidentes-de-ciberseguridad\/\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">pointed out<\/span><\/a><span style=\"font-weight: 400;\"> that it is about \u201cthe execution of what is established in Decree 360\/2019, which has a preventive character and includes the whole of society,\u201d and ensures that it \u201cenables, based on duties and rights, the undifferentiated protection of citizens, civil society and state and private institutions of all kinds.\u201d<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Its objectives include, the publication added, \u201censuring through the management of cybersecurity incidents, prevention, detection and timely response to possible enemy, criminal and harmful activities that may occur in cyberspace.\u201d<\/span><\/p>\n<p><span style=\"font-weight: 400;\">\u201cUnder this new resolution, events that until now did not have legal support in the country on the internet, such as ethical and social damages or incidents of aggression,\u201d the official information specified, according to which in the first category is \u201cthe media echo of fake news, understood as the dissemination of false news, offensive messages, defamation with an impact on the country\u2019s prestige.\u201d<\/span><\/p>\n<blockquote class=\"wp-embedded-content\" data-secret=\"AqNbuM98pq\"><p><a href=\"https:\/\/oncubanews.com\/cuba\/historias-des-conectadas\/\">Historias des-conectadas<\/a><\/p><\/blockquote>\n<p><iframe loading=\"lazy\" class=\"wp-embedded-content\" sandbox=\"allow-scripts\" security=\"restricted\" style=\"position: absolute; clip: rect(1px, 1px, 1px, 1px);\" title=\"\u00abHistorias des-conectadas\u00bb \u2014 OnCubaNews\" src=\"https:\/\/oncubanews.com\/cuba\/historias-des-conectadas\/embed\/#?secret=CwXgprUNeq#?secret=AqNbuM98pq\" data-secret=\"AqNbuM98pq\" width=\"500\" height=\"282\" frameborder=\"0\" marginwidth=\"0\" marginheight=\"0\" scrolling=\"no\"><\/iframe><\/p>\n<p><span style=\"font-weight: 400;\">For its part, it is considered as harmful dissemination \u201cthe dissemination through telecommunications\/ICT infrastructures, platforms or services, of content that violates the constitutional, social and economic precepts of the state, incites mobilizations or other acts that alter the public order; spread messages that justify violence, accidents of any kind that affect the privacy and dignity of people.\u201d<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Similarly, it defines cyberterrorism, cyberwar, fraud and social subversion as \u201cincidents of aggression\u201d with a very high level of danger. Within the first, it includes \u201cactions through the use of ICT whose purpose is to subvert the constitutional order, or to suppress or seriously destabilize the functioning of the political and mass institutions, the economic and social structures of the state, or to force the public powers to perform an act or refrain from doing so.\u201d<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Also \u201cseriously disturb the public peace,\u201d \u201cseriously destabilize the functioning of an international organization\u201d and \u201cprovoke a state of terror in the population or in a part of it.\u201d<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Cyberwar includes \u201cunconventional warfare methods\u201d and others to \u201cjustify political, economic, subversive actions or interference,\u201d while considering fraud any \u201caction that is contrary to truth and righteousness that harms people and institutions of the State.\u201d Meanwhile, \u201cwanting to alter public order\u201d and \u201cpromoting social indiscipline\u201d are considered part of \u201csocial subversion.\u201d<\/span><\/p>\n<blockquote class=\"wp-embedded-content\" data-secret=\"edJ6noo9AO\"><p><a href=\"https:\/\/oncubanews.com\/cuba-ee-uu\/cuba-asegura-que-no-tiene-acceso-libre-a-internet-por-el-embargo\/\">Cuba asegura que no tiene acceso libre a internet por el embargo<\/a><\/p><\/blockquote>\n<p><iframe loading=\"lazy\" class=\"wp-embedded-content\" sandbox=\"allow-scripts\" security=\"restricted\" style=\"position: absolute; clip: rect(1px, 1px, 1px, 1px);\" title=\"\u00abCuba asegura que no tiene acceso libre a internet por el embargo\u00bb \u2014 OnCubaNews\" src=\"https:\/\/oncubanews.com\/cuba-ee-uu\/cuba-asegura-que-no-tiene-acceso-libre-a-internet-por-el-embargo\/embed\/#?secret=Nac6etXMEt#?secret=edJ6noo9AO\" data-secret=\"edJ6noo9AO\" width=\"500\" height=\"282\" frameborder=\"0\" marginwidth=\"0\" marginheight=\"0\" scrolling=\"no\"><\/iframe><\/p>\n<p><span style=\"font-weight: 400;\">Other categories typified by the new resolution, with their different subcategories and levels of danger, have to do with natural disasters, physical damage, incidents against dignity and individuality, illegal commercialization, technical and infrastructure failures, malicious programs, technical attacks or intrusion and compromise of information, among others.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Activists, opponents, unofficial organizations and Internet users fear that the new regulations will be applied at the discretion of the government and will serve to silence dissident voices on the networks and prosecute those who criticize the Cuban system and its leaders. In this sense, complaints and criticisms of the island\u2019s authorities due to the new regulation have already started being published on the social networks.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">In addition, in this Tuesday\u2019s <\/span><i><span style=\"font-weight: 400;\">Gaceta Oficial<\/span><\/i><span style=\"font-weight: 400;\"> other regulations were published that, according to the Ministry of Communications, \u201cupdate\u201d and \u201cstrengthen\u201d Cuba\u2019s legal body on these issues. Among these is Decree-Law No. 35 on \u201cTelecommunications, Information and Communication Technologies and the Use of the Radioelectric Spectrum,\u201d which establishes that \u201cthe Cuban state is the owner of public telecommunications services and has the power to regulate, order, control and supervise the different telecommunications\/ICT services and networks; as well as granting the right to its exploitation,\u201d Cubadebate pointed out.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Finally, the package includes a group of regulations on Information and Communication Technologies, the Radioelectric Spectrum, the use of Radiocommunication Services by Satellites and Interconnection, Access and Essential Installations of Telecommunication
