As night falls, life seems to go on normally in this busy place in the historic center of Havana. There are children playing, young people listening to music, people chatting on benches, others passing by or stopping to buy from a street vendor, tourists entering or leaving a private restaurant in the area, couples who do not hide their love in the sight of the whole neighborhood.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Meanwhile, towards one of the corners of the park, in a renovated secondary school, a group of neighbors is preparing to debate the draft of the new <\/span><a href=\"https:\/\/oncubanews.com\/en\/tag\/family-code\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">Family Code<\/span><\/a><span style=\"font-weight: 400;\">, as part of the popular consultation process that began in February and that will last until next April. Cuban flags, a bust of <\/span><a href=\"https:\/\/oncubanews.com\/en\/tag\/jose-marti\/\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">Jos\u00e9 Mart\u00ed<\/span><\/a><span style=\"font-weight: 400;\"> and photos of the late leader Fidel Castro welcome some thirty participants, including those who are to lead the meeting, to which several media outlets have been invited. I ask one of the organizers about the many people who have been left outside and he tells me that this is just one of several meetings scheduled in the community, that everyone will have their chance to attend an assembly and give their opinion on the Code.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Finally, the meeting begins and, after a brief speech by a neighborhood leader, two invited specialists take the floor, offering a broad explanation of the legislative proposal and dwelling, particularly, on some points that have been the subject of social controversy, such as parental responsibility on children and adolescents, the concept of marriage in all its breadth, adoption and solidarity gestation, domestic violence, and the rights of older adults, the latter endorsed, moreover, by the fact that the participants comprise not a few neighbors of the so-called \u201cthird age.\u201d In line with what the government has reiterated, the experts maintain that it is an inclusive and advanced code, which does not deprive anyone of rights, but, on the contrary, includes all people.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Then comes the turn of the attendees\u2019 opinions, but this part lasts less than imagined. Those who speak say they are mostly in favor of the draft code and agree with the assessments of the specialists about its fairness and inclusiveness. Someone makes an exhaustive comment about the elderly and other people in vulnerable situations, in his opinion now more protected by the Code, and ponders the role of those who care for them, even when they are not blood relatives, to whom he considers it necessary to provide greater legal protection. There is also a proposal to modify the title of a chapter and a question about the minimum age for marriage, which the experts clarify. And a little more. In about an hour and a half, the assembly ends, and the neighbors quietly leave the school. Photo: Eric Caraballoso Diaz.\n\t\t\t\t<\/figcaption><\/figure>\n\t\t<\/div>\n\n<p style=\"text-align: center;\"><span style=\"font-weight: 400;\">***<\/span><\/p>\n<p><span style=\"font-weight: 400;\">I know, from the comments of friends and acquaintances, that not all the assemblies on the Code held up to now \u2015 according to official sources, some 79,000 meeting points have been established throughout the country and <\/span><a href=\"https:\/\/oncubanews.com\/en\/cuba\/opinion-on-the-family-code-also-from-abroad\/\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">also abroad<\/span><\/a><span style=\"font-weight: 400;\">, in which these meetings will be held until next April 30 \u2015 have been as peaceful as this one in the Plaza del Cristo. I have heard of intense controversies and heated debates about different aspects included up to now in the Code \u2015 such as same-sex marriage and the substitution of the concept of parental custody \u2015 and of pages and pages that have had to be filled by those in charge of collecting the opinions of the population in these exchanges. According to <\/span><a href=\"https:\/\/oncubanews.com\/cuba\/cuba-recibe-mas-de-136-000-propuestas-sobre-el-codigo-de-las-familias\/\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">a first cut<\/span><\/a><span style=\"font-weight: 400;\"> of the National Electoral Council (CEN), more than 41,000 assemblies had already been held in which more than 136,000 proposals for the legislation had been compiled.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">However, I also know, from experience in similar situations, that not all people like to say what they think in public, and even less so if the space in which they could do so has been formally organized.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">On the way out of the secondary school, I approach a group of young people who are chatting in the other corner of the park. They tell me that they are between 17 and 19 years old, so they could already vote in the referendum that should approve or not the Family Code, once the possible modifications derived from the popular consultation are made. I ask them if they knew about the assembly that night, but none of them seems to have a clear idea of \u200b\u200bwhat was going on. I tell them about the Code and then one of them tells me that he was already in \u201canother one of those meetings\u201d a few days before, but that he didn\u2019t say anything anyway because he really didn\u2019t know what to say, that \u201cit\u2019s not his style.\u201d \u201cFrom what I\u2019ve heard,\u201d he says, \u201cI think it\u2019s fine, but the truth is that I don\u2019t understand much about those things.\u201d<\/span><\/p>\n<p><span style=\"font-weight: 400;\">A young woman, on the other hand, makes fun of her friend and tells me that the draft Code seems \u201cimportant\u201d to her; that he has read about it and has also seen what they have said on television, and that just for giving voice and rights to everyone within the families, including the youngest, and also because of the option of marrying anyone who wants to do it, whatever their sexual orientation, she is \u201cvery much in agreement.\u201d She tells me that she has a gay cousin, whom she \u201cloves very much,\u201d and that she is glad that the Code gives him the possibility of marrying and leading his life \u201clike any other person,\u201d an idea that other members of her group also claim to support, before going about their business.<\/span><\/p>\n<figure id=\"attachment_250482\" aria-describedby=\"caption-attachment-250482\" style=\"width: 1140px\" class=\"wp-caption aligncenter\"><a href=\"https:\/\/oncubanews.com\/en\/wp-content\/uploads\/2022\/03\/Bandera-cub-gay_otm_1_2-1.jpg\"><img loading=\"lazy\" decoding=\"async\" class=\"size-full wp-image-250482\" src=\"https:\/\/oncubanews.com\/en\/wp-content\/uploads\/2022\/03\/Bandera-cub-gay_otm_1_2-1.jpg\" alt=\"\" width=\"1140\" height=\"760\" srcset=\"https:\/\/oncubanews.com\/en\/wp-content\/uploads\/2022\/03\/Bandera-cub-gay_otm_1_2-1.jpg 1140w, https:\/\/oncubanews.com\/en\/wp-content\/uploads\/2022\/03\/Bandera-cub-gay_otm_1_2-1-300x200.jpg 300w, https:\/\/oncubanews.com\/en\/wp-content\/uploads\/2022\/03\/Bandera-cub-gay_otm_1_2-1-1024x683.jpg 1024w, https:\/\/oncubanews.com\/en\/wp-content\/uploads\/2022\/03\/Bandera-cub-gay_otm_1_2-1-768x512.jpg 768w, https:\/\/oncubanews.com\/en\/wp-content\/uploads\/2022\/03\/Bandera-cub-gay_otm_1_2-1-750x500.jpg 750w\" sizes=\"auto, (max-width: 1140px) 100vw, 1140px\" \/><\/a><figcaption id=\"caption-attachment-250482\" class=\"wp-caption-text\">A Cuban flag and a rainbow flag, representing the LGTBIQ+ community, on a balcony in Havana. Photo: Otmaro Rodr\u00edguez.<\/figcaption><\/figure>\n<p><span style=\"font-weight: 400;\">The position of these young people, however, is not the same as that of Georgina and Arturo, both over 50 years old, with whom I talk a few days later on a tour of the streets of Havana. Both believe that marriage should be \u201conly between a man and a woman,\u201d although for different reasons. Her religious beliefs weigh on her \u2015 she is \u201cChristian,\u201d she tells me without further details \u2015 and she alleges that same-sex marriage goes \u201cagainst the commandments of the Lord,\u201d while she cites \u201ccultural\u201d issues and assures that, although she understands the \u201cgood intention\u201d of the Family Code, it does not seem to her that Cuban society is currently prepared for such a \u201cdrastic\u201d change.<\/span><\/p>\n<blockquote class=\"wp-embedded-content\" data-secret=\"68LyWD9Y6Q\"><p><a href=\"https:\/\/oncubanews.com\/en\/cuba\/family-code-a-guide-for-debate-vii\/\">Family Code, a guide for debate (VII)<\/a><\/p><\/blockquote>\n<p><iframe loading=\"lazy\" class=\"wp-embedded-content\" sandbox=\"allow-scripts\" security=\"restricted\" style=\"position: absolute; clip: rect(1px, 1px, 1px, 1px);\" title=\"&#8220;Family Code, a guide for debate (VII)&#8221; &#8212; OnCubaNews English\" src=\"https:\/\/oncubanews.com\/en\/cuba\/family-code-a-guide-for-debate-vii\/embed\/#?secret=ExFlShC0Fk#?secret=68LyWD9Y6Q\" data-secret=\"68LyWD9Y6Q\" width=\"500\" height=\"282\" frameborder=\"0\" marginwidth=\"0\" marginheight=\"0\" scrolling=\"no\"><\/iframe><\/p>\n<p><span style=\"font-weight: 400;\">Georgina is also concerned that homosexual couples can adopt and raise children because of \u201chow that can affect the development\u201d of these minors, who, from her point of view, would not grow up in a \u201cnormal family.\u201d On the other hand, she is not opposed to the idea of \u200b\u200b solidarity gestation, because she considers it an \u201caltruistic act,\u201d \u201cof love and life,\u201d which gives a couple the opportunity to have children \u2015 always made up of a man and a woman. She also defends the protection of women, the elderly and vulnerable people, aspects that, in her opinion, should be kept in the legislative proposal that will be taken to a referendum.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Arturo, for his part, states that he does not fully understand the concepts of \u201cparental responsibility\u201d and \u201cprogressive autonomy,\u201d nor does he agree that parents \u201cnot have the power to decide about their children\u201d and that \u201cnow we\u2019ll have to let the kids do what they want.\u201d \u201cI don\u2019t think things are exactly as people say out there, because it doesn\u2019t fit in my head,\u201d he points out, \u201cbut, just in case, when the Code meeting is held on my block, I\u2019m going to ask them to clarify that point for me,\u201d and, if it\u2019s like they say, make it clear that I don\u2019t think it\u2019s right. Photo: Otmaro Rodr\u00edguez.\n\t\t\t\t<\/figcaption><\/figure>\n\t\t<\/div>\n\n<p><span style=\"font-weight: 400;\">***<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Magaly is 78 years old, but she says she \u201cstill feels strong\u201d and, as such, she prefers not to spend her days \u201cwith folded arms\u201d or to be treated \u201cas if she were no longer good for anything.\u201d Therefore, she sees \u201cvery well\u201d that the Code defends the rights of older adults and supports the role of grandparents within the family. \u201cI raised two of my grandchildren almost alone because their parents spent a lot of time working and on \u2018missions\u2019 outside the country. They practically lived with me and my husband, and we were the ones who were on top of all their things, including school, so I know very well what I\u2019m talking about,\u201d she says. \u201cLuckily, in my family, there have never been any problems with these issues, but I know of others in which the parents very happily come along and discredit the grandparents in front of the children, and even mistreat them and abandon them, no matter what they have done before for them and their children.\u201d<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Magaly, a retiree, claims to be \u201cin favor of approving\u201d the Code, because, she says, Cuba cannot continue to be governed by a law that \u201cis more than 40 years old\u201d and \u201chas nothing to do\u201d with what the country was at the time it was instituted. However, she regrets not having been able to obtain the tabloid with the text of the draft in order to \u201cread it calmly\u201d and learn \u201cfirst-hand\u201d all the aspects it contains. This \u201cmore than four decades old\u201d housewife confirms that she has had the printed tabloid at hand because her father-in-law \u201cgot it at the newspaper stand,\u201d but that she \u201chardly had time\u201d to consult it. \u201cImagine, I spend the day doing housework, because my husband works, taking care of the kids, my father-in-law, queuing, inventing what to eat, and when I have a free moment, the least I want do is to read,\u201d she says. \u201cTo make matters worse, the other day I decided to do it and I didn\u2019t understand much, not even reading the explanation of the more technical words that are in the back (glossary). And I only read a few pages, but have you seen how long the Code is? Not everyone can understand that, I think.\u201d<\/span><\/p>\n<p><span style=\"font-weight: 400;\">According to her, even her father-in-law, who \u201cdoes have more time to read\u201d and \u201cdoesn\u2019t miss the Mesa Redonda TV program or those lawyer programs (Hacemos Cuba),\u201d \u201che still doesn\u2019t understand many things\u201d of the text, while her husband \u2015 \u201dwho arrives dead tired every day from work\u201d \u2015 says that \u201che is not going to waste time\u201d reading it, because \u201che is not going to understand it either\u201d and \u201cit\u2019s going to be approved even if people do not agree.\u201d Her friend Dunia, she points out, thinks the same and even asserts that \u201cshe is going to vote against\u201d because she is not going to approve \u201csomething she does not know what it says,\u201d but Mayra affirms that she would like to \u201cknow well\u201d the draft, well, \u201cin the end, that is going to be the law for all families in Cuba and it is important to know what it says, in case we will need it at some point.\u201d<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Leonardo, like Mayra, also considers that, \u201ceven if a bit of an effort has to be made,\u201d \u201ceveryone should read the Code and give their opinion.\u201d He, he says, has already done it and gave his evaluations both in the assembly of his neighborhood and, before, digitally, <\/span><a href=\"https:\/\/oncubanews.com\/en\/cuba\/society-cuba\/politics-in-cuba\/cuba-draft-of-family-code-published-to-collect-opinions\/\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">when the previous version<\/span><\/a><span style=\"font-weight: 400;\"> of the draft was published. Photo: Otmaro Rodr\u00edguez.<\/figcaption><\/figure>\n<p><span style=\"font-weight: 400;\">In his opinion, \u201cperhaps the Code should not be taken to a referendum\u201d because \u201cit is about rights for people,\u201d but he considers that \u201cif it has already been decided\u201d then the prior popular consultation and the processing of the assessments derived from it must be done \u201cas it should be, without bias or formalism.\u201d \u201cI believe that everyone\u2019s opinions must be listened to and taken into account,\u201d says Leonardo, who thinks that in this way \u201cthe Code will truly resemble more what Cubans think.\u201d In this sense, he highlights the importance of the draft Code being \u201cexplained in detail\u201d by specialists, so that people \u201ccan better understand its content\u201d and \u201cunderstand its benefits,\u201d but he is concerned about the insistence of the authorities and the media on the subject because he fears that this, far from helping, will lead to a possible boomerang effect.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">\u201cPeople have to be given all the elements so that they can analyze the draft and then decide if they support it. That\u2019s fine,\u201d he points out. \u201cBut it seems to me that (the authorities) are overloading the media a bit, with a campaign that, moreover, openly takes sides in favor of the Code, and I have already heard opinions against it, not so much because they disagree with what it says, but to contradict the government. And that seems terrible to me. I believe that if it is finally approved, the Code can help make Cuba a better country, because it will better represent families legally, and I trust that most people are aware of that. But that is something that, in the end, the people themselves have to confirm with their opinions and with their vote, they are the ones that really have to count when making a
