
{"id":254182,"date":"2022-06-15T16:44:55","date_gmt":"2022-06-15T20:44:55","guid":{"rendered":"https:\/\/oncubanews.com\/en\/?p=254182"},"modified":"2022-06-15T16:44:55","modified_gmt":"2022-06-15T20:44:55","slug":"cuban-district-attorneys-office-confirms-sanctions-against-381-people-for-july-2021-protests","status":"publish","type":"post","link":"https:\/\/oncubanews.com\/en\/cuba\/cuban-district-attorneys-office-confirms-sanctions-against-381-people-for-july-2021-protests\/","title":{"rendered":"Cuban district attorney\u2019s office confirms sanctions against 381 people for July 2021 protests"},"content":{"rendered":"<p><span style=\"font-weight: 400;\">The Attorney General\u2019s Office of the Republic of Cuba (FGR) <\/span><a href=\"https:\/\/www.fgr.gob.cu\/noticias\/informacion-de-la-fiscalia-general-de-la-republica-sobre-los-procesos-penales-derivados-de?fbclid=IwAR3zUnQSbq_7MFPBQSmo1hjJgR4xdBDa1PThTB8aFRaTVeGO87QFSBGBgG0\" target=\"_blank\" rel=\"noopener\"><b>reported this Monday <\/b><\/a><span style=\"font-weight: 400;\">that so far 381 people have been sanctioned for the <\/span><a href=\"https:\/\/oncubanews.com\/en\/tag\/july-11\" target=\"_blank\" rel=\"noopener\"><b>July 2021 anti-government protests<\/b><\/a><span style=\"font-weight: 400;\">, 16 of them aged between 16 and 18 years.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">In <\/span><a href=\"https:\/\/www.fgr.gob.cu\/noticias\/informacion-de-la-fiscalia-general-de-la-republica-sobre-los-procesos-penales-derivados-de\" target=\"_blank\" rel=\"noopener\"><b>a note<\/b><\/a><span style=\"font-weight: 400;\"> published on its website and shared on its social network profiles, the FGR assured that \u201cafter the period for the defendants or the district attorney to establish the appeals against the sentences handed down, in exercise of the right that assists them legally, or because these have been resolved,\u201d the courts notified 76 final sentences.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">\u201cOf the 381 people who were sanctioned there were 16 young people aged between 16 and 18, mainly for crimes of sedition; sabotage; robbery with force and violence; attempt; contempt and public disorder,\u201d confirmed the statement, according to which \u201c297 defendants were imposed prison sentences, based on the seriousness and circumstances in which the events occurred and personal conduct.\u201d<\/span><\/p>\n<p><span style=\"font-weight: 400;\">\u201cFor the crime of sedition, 36 were sanctioned; they were sentenced to between 5 and 25 years of imprisonment,\u201d the note added.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">According to the district attorney \u201c84 defendants were subsidized the sanction of imprisonment, for other alternative penalties that do not imply \u2014 in principle, under the condition of good conduct \u2014, their imprisonment.\u201d Among these alternative penalties are those of correctional labor with and without internment, and limitation of liberty. \u201cThis decision includes 15 of the young people between the ages of 16 and 18,\u201d the FGR said.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">In Cuba, the minimum criminal age is 16 years.<\/span><\/p>\n<blockquote class=\"twitter-tweet\" data-width=\"500\" data-dnt=\"true\">\n<p lang=\"es\" dir=\"ltr\">INFORMACI\u00d3N DE LA FISCAL\u00cdA GENERAL DE LA REP\u00daBLICA SOBRE LOS PROCESOS PENALES DERIVADOS DE LOS DISTURBIOS PROVOCADOS EL 11 DE JULIO DE 2021<a href=\"https:\/\/t.co\/P3qvFuhOlO\">https:\/\/t.co\/P3qvFuhOlO<\/a><\/p>\n<p>&mdash; Fiscal\u00eda de Cuba (@FGR_Cuba) <a href=\"https:\/\/twitter.com\/FGR_Cuba\/status\/1536318232424026114?ref_src=twsrc%5Etfw\">June 13, 2022<\/a><\/p><\/blockquote>\n<p><script async src=\"https:\/\/platform.twitter.com\/widgets.js\" charset=\"utf-8\"><\/script><\/p>\n<p><span style=\"font-weight: 400;\">In its note, the FGR recalls that \u201cthe breach of the obligations imposed by the Court in its sentences or the commission of a new criminal act, results in the revocation of the subsidiary sanction and the fulfillment of the rest of the original sentence in prison.\u201d<\/span><\/p>\n<p><span style=\"font-weight: 400;\">In addition, it affirms that \u201cin the sentences issued, the People\u2019s Courts ruled in each case for the civil responsibility of compensating the people who were injured, as a consequence of the acts committed, and the reparation of the damages caused to the entities.\u201d<\/span><\/p>\n<p><span style=\"font-weight: 400;\">And finally, it points out that \u201cat this time, it corresponds to start the process of executing the firm sanctions imposed, and to ensure during their compliance that their educational, coercive and preventive purposes are achieved, the reinforcement of values, the rectification of behavior of those sanctioned and their social reinsertion.\u201d<\/span><\/p>\n<p><span style=\"font-weight: 400;\">For her part, the chief prosecutor of the Department of Criminal Proceedings of the Attorney General\u2019s Office of the Republic, Lisnay Mar\u00eda Mederos, <\/span><a href=\"http:\/\/www.cubadebate.cu\/noticias\/2022\/06\/13\/fiscalia-general-de-la-republica-actualiza-sobre-procesos-penales-derivados-del-11-de-julio\/#anexo-1698749\" target=\"_blank\" rel=\"noopener\"><b>commented<\/b><\/a><span style=\"font-weight: 400;\">\u00a0to the official Cubadebate website that \u201cduring these processes, compliance with the constitutional rights and guarantees of the due process was established and the investigations carried out by the agencies of the Ministry of the Interior were controlled.\u201d<\/span><\/p>\n<p><span style=\"font-weight: 400;\">\u201cThe attorneys maintained communication with their clients, agreed to the proceedings and provided the evidence they considered appropriate,\u201d added Mederos, who said that the prosecution\u2019s actions \u201cwas based on a set of documentary, testimonial and expert evidence, which made it possible to establish and determine the participation of the accused in acts that are typified as a crime in the current Penal Code.\u201d<\/span><\/p>\n<p><span style=\"font-weight: 400;\">The foregoing contrasts with the testimonies of activists and relatives of the sentenced, who have alleged lack of guarantees, fabrication of evidence and other irregularities in the processes, while criticizing the high sentences imposed, although it was recently reported that the island\u2019s Supreme Court had reduced the sentence of some demonstrators.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">According to the EFE news agency, the numbers released this Monday do not coincide with those published by different NGOs since the J11 trials began at the end of 2021. Prisoners Defenders, for example, noted on June 8 that a total of 168 demonstrators had been prosecuted solely for the crime of sedition and that 246 had firm prison sentences of 10 years or more.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">This Madrid-based organization itself has indicated that at least 1,046 people were in prison on the island as of May for political reasons, mostly due to the July 2021 protests. Neither the Cuban authorities nor the official media acknowledge the existence of political prisoners in the country and attribute to these people crimes such as those that motivated the processes against the demonstrators.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">At the end of May, the organization Justicia 11J reported that 519 of 564 people who had been tried in Cuba for the demonstrations \u2014 92% \u2014 were convicted and 40 were still awaiting their sentence, the Spanish media pointed out.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">For its part, <\/span><a href=\"https:\/\/oncubanews.com\/cuba\/cuba-fiscalia-informa-sobre-procesos-penales-por-las-protestas-del-11-de-julio\/\" target=\"_blank\" rel=\"noopener\"><b>the FGR itself assured in January<\/b><\/a><span style=\"font-weight: 400;\"> that 790 people had been prosecuted for \u201cacts of vandalism\u201d and \u201cserious disturbances of order,\u201d of which 55 were between 16 and 17 years old.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">The district attorney\u2019s office then assured that in these cases it has verified \u201ccompliance with the constitutional rights and guarantees of due process,\u201d despite the \u201cmanipulations and opinion matrices, which seek to accuse Cuba of human rights violations.\u201d<\/span><\/p>\n<p><span style=\"font-weight: 400;\">According to the statement issued on that occasion, after the investigation was concluded, the FGR received 117 preparatory phase files on the events of \u201chighest connotation,\u201d these files implicated 790 people instructed \u201cfor acts of vandalism, attacking authorities, people and property, as well as serious disturbances of order.\u201d According to the note, 21% had criminal records.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Of that total, 110 files had been presented to the courts at that time, with 710 defendants for trial.
