If violence is exercised during the event or the action of the forces of public order is resisted, the penalties will be a prison sentence of between two and five years. And the fines, up to 1,000 quotas.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Thus states <\/span><a href=\"https:\/\/www.tsp.gob.cu\/noticias\/gaceta-oficial-no17-extraordinaria-de-2-de-marzo-de-2023-dictamen-471\" target=\"_blank\" rel=\"noopener\"><b>ruling 471\/2023<\/b><\/a><span style=\"font-weight: 400;\"> of the People\u2019s Supreme Court (TSP), which represents a significant toughening of the procedure for the mentioned cases. Until its publication and entry into force, those affected by the occupation of dwellings had to appeal to the so-called \u201cadministrative route.\u201d Through it, it corresponded to the municipal housing departments and the municipal assemblies of People\u2019s Power confrontation commissions to \u201cexecute the extraction\u201d of the intruders.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">But the system used to be slow. A <\/span><a href=\"http:\/\/www.vanguardia.cu\/villa-clara\/22391-historias-agridulces-de-la-vivienda-en-santa-clara\" target=\"_blank\" rel=\"noopener\"><b>report<\/b><\/a><span style=\"font-weight: 400;\">\u00a0from the <\/span><i><span style=\"font-weight: 400;\">Vanguardia<\/span><\/i><span style=\"font-weight: 400;\"> newspaper in June 2022 detailed how 85 illegal occupation resolutions had been filed in Santa Clara between 2008 and 2021. Of these, 30 were still pending solution.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">The phenomenon tends to worsen due to emigration, population aging and the housing shortage. Only in the first five months of 2022, eight files were opened for new occupations in that province. The average in the previous thirteen years had been 6.5 processes per year (2008-2021).<\/span><\/p>\n<figure id=\"attachment_267210\" aria-describedby=\"caption-attachment-267210\" style=\"width: 684px\" class=\"wp-caption aligncenter\"><a href=\"https:\/\/oncubanews.com\/en\/wp-content\/uploads\/2023\/03\/Cuba-2022-fotos-Kaloian12-de-enero-de-2022-4-684x1024-1.jpg\"><img loading=\"lazy\" decoding=\"async\" class=\"size-full wp-image-267210\" src=\"https:\/\/oncubanews.com\/en\/wp-content\/uploads\/2023\/03\/Cuba-2022-fotos-Kaloian12-de-enero-de-2022-4-684x1024-1.jpg\" alt=\"\" width=\"684\" height=\"1024\" srcset=\"https:\/\/oncubanews.com\/en\/wp-content\/uploads\/2023\/03\/Cuba-2022-fotos-Kaloian12-de-enero-de-2022-4-684x1024-1.jpg 684w, https:\/\/oncubanews.com\/en\/wp-content\/uploads\/2023\/03\/Cuba-2022-fotos-Kaloian12-de-enero-de-2022-4-684x1024-1-200x300.jpg 200w\" sizes=\"auto, (max-width: 684px) 100vw, 684px\" \/><\/a><figcaption id=\"caption-attachment-267210\" class=\"wp-caption-text\">Photo: Kaloian.<\/figcaption><\/figure>\n<p><span style=\"font-weight: 400;\">Some affected owners preferred to solve the problem themselves, rather than risk that the occupation of the dwelling would be prolonged, and the property suffer irreparable damage. This is what happened to Margarita Mart\u00ednez, one of those interviewed by the Villa Clara newspaper. She managed to recover the house of her daughter who had emigrated thanks to the fact that some relatives persuaded the two young women who had occupied it. Not before, however, the front door had been destroyed and a security camera and its hard drive removed.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">The TSP ruling issued in March authorizes the owners to file complaints for the crime of usurpation, which was previously reserved for the invasion of state property. According to the TSP, the decision responds to \u201ccriteria and concerns\u201d raised by parliamentarians during the debates on the new Penal Code, in May 2022.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">\u201cThe foundations that supported this provision [the former preeminence of the \u2018administrative route\u2019] responded to circumstances and situations other than the socioeconomic conditions in which the country currently operates,\u201d the ruling justified.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">With the new provision, the police are committed to intervening in the conflict. Previously, law enforcement was only involved when the situation turned violent; almost always to arrest those involved and very rarely to attend to the reason for the dispute, the occupation itself.<\/span><\/p>\n<p><b>Less construction, more guarantees for emigrated owners<\/b><\/p>\n<p><span style=\"font-weight: 400;\">In 2022, 21,229 homes were built in Cuba, some 2,000 more than in the previous year; but only <\/span><a href=\"https:\/\/www.granma.cu\/cuba\/2022-12-11\/analizan-el-cumplimiento-de-la-politica-de-la-vivienda-11-12-2022-23-12-16\" target=\"_blank\" rel=\"noopener\"><b>58% of what was projected<\/b><\/a><span style=\"font-weight: 400;\">. Failure to meet the plan is greater if it is contrasted with the estimates of the <\/span><a href=\"https:\/\/oncubanews.com\/wp-content\/uploads\/2023\/03\/Micons_-Politica-de-la-Vivienda-1.pdf\" target=\"_blank\" rel=\"noopener\"><b>Housing Policy in Cuba (2018)<\/b><\/a><span style=\"font-weight: 400;\">. This was enacted to end the housing deficit on the island after a decade. According to its execution schedule, 48,143 dwellings had to be built and 37,827 rehabilitated in 2022. But a <\/span><a href=\"https:\/\/oncubanews.com\/en\/tag\/coronavirus\/\" target=\"_blank\" rel=\"noopener\"><b>pandemic<\/b><\/a><span style=\"font-weight: 400;\">\u00a0and four years of economic crisis have made the government more cautious in managing its expectations and the figures that materialize them.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">The 2023 national plan has not yet been made public in March. Only some partial and provincial-level statistics are available.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">At the end of February, during a <\/span><a href=\"http:\/\/www.cubadebate.cu\/noticias\/2023\/03\/01\/primer-ministro-sobre-programa-nacional-de-la-vivienda-no-se-ha-logrado-avanzar\/\" target=\"_blank\" rel=\"noopener\"><b>videoconference between Prime Minister<\/b><\/a><span style=\"font-weight: 400;\"> Manuel Marrero and governors and mayors, it was learned that 1,310 homes had been completed nationwide in January. In addition, that another 65 had pending the certificate of habitability due to delays in their connection to the aqueduct and electricity services, and the completion of their technical documentation.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">\u201cIt cannot be said that work is not being done, but we are not doing it well,\u201d Marrero said then.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">In 2018, the Housing Policy estimated the housing deficit (the sum of new homes and those that are to be rehabilitated) on the island at 929,695 units. Of these, 527,000 should be new constructions. The most recurring is that of a commission made up of parliamentarians and lawyers that would reconsider the requirements for the exercise of property ownership. Currently, it is only possible to own a home in urban or rural areas, and another in beach areas. For the \u201cactive\u201d exercise of ownership (without mediation of powers) it is necessary to have residence status on the island.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">In November, the website <\/span><i><span style=\"font-weight: 400;\">14 y medio<\/span><\/i> quoted<span style=\"font-weight: 400;\"> a lawyer who declared that the objective of the commission is to suggest \u201cchanges that adjust to the current scenario of large numbers of emigrants.\u201d The proposals would aim to ensure that residents abroad do not lose their rights as owners and to allow a person to have more than one house in their name.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">The note concluded with a reference to the large number of powers of attorney processed in the last two years, due to the increase in emigration of Cubans. \u201cThere is a case of a person who has several powers of attorney from several relatives and, on top of that, must physically take care of those homes that they have been left in charge of,\u201d said an official.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Among the emigrants, a part did not want or could not sell the property. Others, despite residing abroad, have bought a house on the island.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">\u201cThe home buying and selling market is very active; in fact, it is almost the only one that remains that way after the \u2018fury\u2019 caused by the Nicaraguan route,\u201d says Jos\u00e9 Luis, a real estate broker. In Camag\u00fcey, he \u201cmanages on the ground\u201d (he deals with the bureaucracy, too) sales often negotiated in Miami and other U.S. cities. Usually, his clients come from two large networks: those who know each other previously, and those who get in touch through one of the <\/span><a href=\"https:\/\/hogarencuba.com\/\" target=\"_blank\" rel=\"noopener\"><b>Facebook pages <\/b><span style=\"font-weight: 400;\">or<\/span><b> groups<\/b><\/a><span style=\"font-weight: 400;\"> specialized in the subject.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">The large number of members of the virtual groups shows that there is interest in investing in Cuba. However, due to the blockade, real estate agents registered in the United States cannot openly provide services to emigrants interested in acquiring a home in Cuba, my interviewee considers, that is why they go to real estate brokers.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">\u201cA lady that we recently helped with the procedures to exchange her house for a larger one with change, commented that despite having lived in the United States for more than ten years and being an American citizen, she greatly values the properties she has in Cuba. With $20,000 or $25,000 you can\u2019t do much in the real estate market in the United States; but in Cuba yes,\u201d concludes Jos\u00e9 Luis.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">When the <\/span><a href=\"https:\/\/oncubanews.com\/wp-content\/uploads\/2023\/03\/proyecto-de-ley-de-la-Expropiacion_0.pdf\" target=\"_blank\" rel=\"noopener\"><b>Cuban Expropriation Law<\/b><\/a><span style=\"font-weight: 400;\"> was approved last December, there was no shortage of debates on social networks with a common denominator: \u201cthey are going to take away the dwellings\u201d of the emigrants. But the prospects point to a radically different scenario. It is reflected in the promulgation of regulations that would favor the owners, whether or not they live in the properties. In addition, indirectly, it would make it possible to bring positions closer to the emigrant community, a determining factor in the economic and social life of the country. In many cases this sector is the title holder of farms and houses on the island.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">It would be a profound reform, since until now the limit of one property per person and the requirement that its owners have permanent residence in Cuba have been fundamental stones of the legal architecture on the subject, based on the current General Housing Law.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">The hypothetical relaxation of said Law would occur in a particularly difficult context. The studies that in 2018 founded the National Housing Policy calculated that more than 39% of the properties of this nature in Cuba were in fair or poor condition. In 2015, the average number of cohabitants per \u201chousehold\u201d \u2014 terminology used by the National Office of Statistics and Information \u2014 <\/span><a href=\"https:\/\/www.granma.cu\/cuba\/2022-04-03\/se-espera-una-reduccion-del-tamano-promedio-de-los-hogares-cubanos-para-el-2030#:~:text=La%20publicaci%C3%B3n%20explica%20que%20el,Estad%C3%ADstica%20e%20Informaci%C3%B3n%20(ONEI)\" target=\"_blank\" rel=\"noopener\"><b>was<\/b><\/a><span style=\"font-weight: 400;\"> 2.91 individuals in Cuba. Considering the average, the condition of the housing fund and the estimated housing deficit (over half a million units), it is inevitable to conclude that the housing conditions of approximately one and a half million Cubans are far from optimal, even decent in many cases.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">The \u201cpenalization\u201d of illegal occupations of real estate sends a signal about the line of action of the government in the near future. In the absence of sufficient resources to solve the housing problem, efforts are concentrated on the regulation and management of the property. At least that gives the idea that \u201csomething is being done.\u201d<\/span><\/p>\n<p><span style=\"font-weight: 400;\">The reality, however, is that there is a lack of housing. And this circumstance will not change because the sanctions against illegal squatters are tightened or the concentration of such a basic asset in the hands of owners who are often absent is endorsed.
