{"id":267730,"date":"2023-04-06T16:37:25","date_gmt":"2023-04-06T20:37:25","guid":{"rendered":"https:\/\/oncubanews.com\/en\/?p=267730"},"modified":"2023-04-06T16:37:25","modified_gmt":"2023-04-06T20:37:25","slug":"banco-nacional-de-cuba-will-appeal-british-courts-ruling-on-debt","status":"publish","type":"post","link":"https:\/\/oncubanews.com\/en\/cuba\/banco-nacional-de-cuba-will-appeal-british-courts-ruling-on-debt\/","title":{"rendered":"Banco Nacional de Cuba will appeal British court\u2019s ruling on debt"},"content":{"rendered":"<p><span style=\"font-weight: 400;\">The Banco Nacional de Cuba (BNC) will appeal the ruling of the <\/span><a href=\"https:\/\/oncubanews.com\/en\/tag\/cuba-and-uk\" target=\"_blank\" rel=\"noopener\"><b>British<\/b><\/a><span style=\"font-weight: 400;\"> court, which this Tuesday considered legitimate a debt claimed by the CRF-I Limited investment fund, from the Cayman Islands.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">That same ruling, issued by Judge Sara Cockerill, of the Commercial Chamber of the London High Court, <\/span><a href=\"https:\/\/oncubanews.com\/en\/cuba\/cuba-wins-trial-against-crf-i-limited-fund\/\" target=\"_blank\" rel=\"noopener\"><b>disallowed<\/b><\/a><span style=\"font-weight: 400;\">\u00a0the consideration of the Republic of Cuba, which had also been sued by CRF, as a debtor.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">The decision to appeal was confirmed by Cuban Minister of Justice Oscar Silvera, who assured that the foreign financial institution, which the island\u2019s authorities classify as a \u201cvulture fund,\u201d acted \u201cin bad faith\u201d when filing the lawsuit.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Silvera stated that \u201cthere are documents that prove the intention to harm the country and affect the financial flows of the Cuban economy,\u201d <\/span><a href=\"https:\/\/www.prensa-latina.cu\/2023\/04\/05\/banco-nacional-de-cuba-apelara-decision-de-tribunal-britanico\" target=\"_blank\" rel=\"noopener\"><b>according<\/b><\/a><span style=\"font-weight: 400;\"> to Prensa Latina (PL) news agency.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">The investment fund itself had admitted during the trial that it had acquired the debt \u201cwith the sole purpose of initiating this legal claim to force its payment,\u201d according to international media reports at the time.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">The debt bonds were previously in the name of ICBC Standard Bank, a British subsidiary of Chinese ICBC bank, and are derived from a loan made to the BNC by two European banking institutions in 1984.<\/span><\/p>\n<blockquote class=\"wp-embedded-content\" data-secret=\"gQGWaK4abF\"><p><a href=\"https:\/\/oncubanews.com\/en\/cuba\/cuba-willing-to-negotiate-its-debt-with-legitimate-creditors\/\">Cuba willing to negotiate its debt with \u201clegitimate\u201d creditors<\/a><\/p><\/blockquote>\n<p><iframe loading=\"lazy\" class=\"wp-embedded-content\" sandbox=\"allow-scripts\" security=\"restricted\" style=\"position: absolute; clip: rect(1px, 1px, 1px, 1px);\" title=\"&#8220;Cuba willing to negotiate its debt with \u201clegitimate\u201d creditors&#8221; &#8212; OnCubaNews English\" src=\"https:\/\/oncubanews.com\/en\/cuba\/cuba-willing-to-negotiate-its-debt-with-legitimate-creditors\/embed\/#?secret=X1liz8LQX9#?secret=gQGWaK4abF\" data-secret=\"gQGWaK4abF\" width=\"500\" height=\"282\" frameborder=\"0\" marginwidth=\"0\" marginheight=\"0\" scrolling=\"no\"><\/iframe><\/p>\n<p><span style=\"font-weight: 400;\">The minister of justice pointed out that \u201cCuba is immune to English jurisdiction,\u201d and that \u201cit has no obligation to respond with its assets to the lawsuit,\u201d the report said.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Silvera, like the government and the official Cuban media, considered Tuesday\u2019s ruling \u201ca victory\u201d for the island and explained, <\/span><a href=\"https:\/\/www.prensa-latina.cu\/2023\/04\/05\/cuba-cumplio-estrictamente-obligaciones-procesales-en-londres\" target=\"_blank\" rel=\"noopener\"><b>quoted<\/b><\/a><span style=\"font-weight: 400;\">\u00a0by PL, that \u201can unfavorable result would have led to possible withholdings of state assets and even new impediments to access international financial flows.\u201d<\/span><\/p>\n<p><span style=\"font-weight: 400;\">However, the process continues against the BNC, since, according to estimates by the British judge, the Cuban bank is indeed a debtor of 72 million euros (78 million dollars) and the CRF can file a lawsuit for non-payment.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">In addition, the magistrate considered that, unlike the Republic of Cuba, the BNC \u201cis not immune to the jurisdiction of the Court\u201d in which the matter was judged.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">However, in Silvera\u2019s opinion, CRF-I Limited is not a legitimate creditor of Cuba or \u201cof any of its institutions,\u201d the Cuban press agency said.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">The Cayman Islands fund was created to invest in Cuba\u2019s unpaid sovereign debt and has a bond portfolio that in 2017 amounted to 1.2 billion euros (1.3 billion dollars at current exchange rates).
