The future <\/span>Immigration<\/b><\/a> Law, whose approval by the Cuban parliament is scheduled for this year, promises to fulfill a long-standing desire of Cubans: to eliminate the limit of 24 months of stay abroad to reside on the island.<\/span><\/p>\n

Even though this limit is currently \u201cfrozen\u201d thanks to a moratorium in force since the pandemic, the new law \u2015 published this Monday by the <\/span>National Assembly<\/b><\/a> as a preliminary step to its parliamentary support \u2015 would be responsible for giving it the final thrust.<\/span><\/p>\n

The new regulation, which comes to light even <\/span>as a legislative draft<\/b><\/a>, introduces the concept of \u201ceffective immigration residence\u201d and seeks to offer \u201cimmigration solutions that contribute to the insertion of Cubans into the new economic model.\u201d<\/span><\/p>\n

According to the 65-page text published together with the <\/span>draft Law on Aliens<\/b><\/a>, \u201cthe time of stay of 24 months abroad and the designation of migrant, for this reason, are eliminated, based on the new definition of effective immigration residence.\u201d<\/span><\/p>\n

In its foundation, it points out that, in accordance with \u201cthe best international practices,\u201d it provides \u201ctreatment of Cubans, when they are in the national territory, similar to that of Cuban residents, except in those aspects that the Law establishes otherwise.\u201d<\/span><\/p>\n

Furthermore, in its first article, the new law establishes as its object \u201cto regulate the Cuban migratory process, under a systemic condition of development,\u201d while stating that it is aimed at \u201cachieving regular, orderly and safe migration, according to what is established in the Constitution.\u201d<\/span><\/p>\n
