{"id":305897,"date":"2024-07-20T20:35:57","date_gmt":"2024-07-21T00:35:57","guid":{"rendered":"https:\/\/oncubanews.com\/en\/?p=305897"},"modified":"2024-07-20T20:35:57","modified_gmt":"2024-07-21T00:35:57","slug":"laws-on-immigration-citizenship-and-aliens-in-cuba-some-keys-and-doubts","status":"publish","type":"post","link":"https:\/\/oncubanews.com\/en\/nation-and-migration\/laws-on-immigration-citizenship-and-aliens-in-cuba-some-keys-and-doubts\/","title":{"rendered":"Laws on Immigration, Citizenship and Aliens in Cuba: Some keys and doubts"},"content":{"rendered":"<p><span style=\"font-weight: 400;\">The Cuban parliament addressed the future Laws on Immigration, Citizenship and Aliens, three regulations that are generating doubts and controversy due to their possible repercussions in the midst of the largest exodus the island has suffered in decades.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">The <\/span><a href=\"https:\/\/www.parlamentocubano.gob.cu\/\" target=\"_blank\" rel=\"noopener\"><b>National Assembly of People\u2019s Power<\/b><\/a><span style=\"font-weight: 400;\"> (ANPP) approved with hardly any modifications the bills for these three laws that go hand in hand and that have been presented publicly in recent weeks.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">These are, according to experts, the main changes that these three regulations incorporate, as well as the biggest questions they generate for Cubans living both inside and outside the country.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">The reforms are key for hundreds of thousands of Cubans; many have left the island in recent years and others have plans to migrate.<\/span><\/p>\n<blockquote class=\"wp-embedded-content\" data-secret=\"GqHsRRB5cr\"><p><a href=\"https:\/\/oncubanews.com\/en\/nation-and-migration\/cuba-already-has-a-new-law-on-immigration\/\">Cuba already has a new Law on Immigration<\/a><\/p><\/blockquote>\n<p><iframe loading=\"lazy\" class=\"wp-embedded-content\" sandbox=\"allow-scripts\" security=\"restricted\" style=\"position: absolute; clip: rect(1px, 1px, 1px, 1px);\" title=\"&#8220;Cuba already has a new Law on Immigration&#8221; &#8212; OnCubaNews English\" src=\"https:\/\/oncubanews.com\/en\/nation-and-migration\/cuba-already-has-a-new-law-on-immigration\/embed\/#?secret=xDmAiITOLg#?secret=GqHsRRB5cr\" data-secret=\"GqHsRRB5cr\" width=\"500\" height=\"282\" frameborder=\"0\" marginwidth=\"0\" marginheight=\"0\" scrolling=\"no\"><\/iframe><\/p>\n<p><b>Effective residence<\/b><\/p>\n<p><span style=\"font-weight: 400;\">Residence in Cuba can no longer be maintained by entering at least briefly every 24 months or requesting extensions from abroad. However, with some exceptions, it will be necessary to live in the country for more than half of the year.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">The doubts that arose regarding the repercussions that this change could have on property rights seem to be resolved with the announcement of the inclusion of an article that would guarantee that Cubans abroad could own a house or a car on the island.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">The uncertainty came from the current General Law on Housing, which ensures that Cubans who spend 24 consecutive months outside the country lose their property rights. The new regulation also contemplates that non-resident Cubans can inherit properties on the island if they comply with procedures and requirements.<\/span><\/p>\n<p><b>Withdrawal of citizenship<\/b><\/p>\n<p><span style=\"font-weight: 400;\">The Citizenship bill empowers the president of Cuba to strip citizenship by decree from those who enlist \u201cin any type of armed organization with the objective of attacking\u201d Cuba or its citizens and from those who carry out \u201cacts contrary to high political, economic and social interests\u201d of the country.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">The affected person must reside outside the country or have another nationality for their citizenship to be withdrawn, although exceptions are considered for \u201cserious\u201d reasons.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Several NGOs and human rights defenders have warned about the potential political use of denationalization in Cuba, pointing to Nicaragua as a recent example.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Last November, the Council of Ministers approved a terrorist list that includes 61 people, including activists, exile leaders and \u201cinfluencers,\u201d as well as 19 organizations, mostly based in the United States.<\/span><\/p>\n<blockquote class=\"wp-embedded-content\" data-secret=\"4jx29ZseEh\"><p><a href=\"https:\/\/oncubanews.com\/en\/nation-and-migration\/no-one-loses-a-property-with-the-new-migration-law-says-minint\/\">\u201cNo one loses a property\u201d with the new migration law, says MININT<\/a><\/p><\/blockquote>\n<p><iframe loading=\"lazy\" class=\"wp-embedded-content\" sandbox=\"allow-scripts\" security=\"restricted\" style=\"position: absolute; clip: rect(1px, 1px, 1px, 1px);\" title=\"&#8220;\u201cNo one loses a property\u201d with the new migration law, says MININT&#8221; &#8212; OnCubaNews English\" src=\"https:\/\/oncubanews.com\/en\/nation-and-migration\/no-one-loses-a-property-with-the-new-migration-law-says-minint\/embed\/#?secret=Ufzl92Gd18#?secret=4jx29ZseEh\" data-secret=\"4jx29ZseEh\" width=\"500\" height=\"282\" frameborder=\"0\" marginwidth=\"0\" marginheight=\"0\" scrolling=\"no\"><\/iframe><\/p>\n<p><b>Residence for the rich and investors<\/b><\/p>\n<p><span style=\"font-weight: 400;\">The Immigration bill gives the possibility for people with \u201csignificant assets\u201d to apply for permanent residence, as well as those who want to \u201cmake investments\u201d in Cuba, for whom a new immigration category is created. Until now, foreigners could only obtain it through marriage or by recognizing children.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">At various points in these regulations, economic reasons are referred to. That of Immigration, for example, assures in its introduction that it seeks to offer \u201cimmigration solutions\u201d in the context of the \u201cnew economic model.\u201d<\/span><\/p>\n<p><b>Entry into and exit from the country<\/b><\/p>\n<p><span style=\"font-weight: 400;\">The Immigration bill allows authorities to prohibit entry into Cuba to people related to \u201chostile actions against the political, economic and social foundations of the Cuban State\u201d or for \u201creasons of defense and national security.\u201d<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Any person can also be prohibited from leaving for \u201creasons of defense and national security,\u201d for \u201clacking the established authorization\u201d for being considered a \u201cqualified workforce\u201d for the country, to \u201cguarantee the security and protection of official information\u201d and, even, for \u201cpublic interest.\u201d<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Doctors, soldiers and journalists, among other professionals, have historically had their departure from Cuba limited. Some opponents and activists have also been \u201cregulated.\u201d Likewise, several Cuban activists, intellectuals and academics have denounced in recent years that, without explanation, they have been denied entry back into the country after leaving for another country.<\/span><\/p>\n<p><i><span style=\"font-weight:
