
{"id":310112,"date":"2024-09-24T21:21:10","date_gmt":"2024-09-25T01:21:10","guid":{"rendered":"https:\/\/oncubanews.com\/en\/?p=310112"},"modified":"2024-09-24T21:21:10","modified_gmt":"2024-09-25T01:21:10","slug":"new-regulations-for-private-sector-come-into-force","status":"publish","type":"post","link":"https:\/\/oncubanews.com\/en\/cuba\/economy\/new-regulations-for-private-sector-come-into-force\/","title":{"rendered":"New regulations for private sector come into force"},"content":{"rendered":"<p><span style=\"font-weight: 400;\">The new regulations for the <\/span><a href=\"https:\/\/oncubanews.com\/en\/tag\/private-sector-in-cuba\" target=\"_blank\" rel=\"noopener\"><b>private sector in Cuba<\/b><\/a><span style=\"font-weight: 400;\">, announced last month by the government, came into force this Thursday, 30 days after their publication in the <\/span><i><span style=\"font-weight: 400;\">Gaceta Oficial<\/span><\/i><span style=\"font-weight: 400;\">.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">The package of measures includes a group of decree laws and resolutions defended by the authorities as an \u201cupdate\u201d of what has been regulated so far for non-state actors and which, they say, seek to regulate their operation in the current economic scenario.<\/span><\/p>\n<p><a href=\"https:\/\/oncubanews.com\/cuba\/economia\/nuevas-reglas-para-el-sector-privado-en-cuba-control-bancarizacion-y-residencia-efectiva\/\"><b>The regulations<\/b><\/a><span style=\"font-weight: 400;\">, which have generated criticism among many private individuals and economists, largely maintain the regulations already in place and add new provisions. They are aimed at <\/span><a href=\"https:\/\/oncubanews.com\/en\/tag\/msmes\/\" target=\"_blank\" rel=\"noopener\"><b>micro, small and medium-sized enterprises (MSMEs)<\/b><\/a><span style=\"font-weight: 400;\">, as well as non-agricultural cooperatives and self-employed workers.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Among the regulations, it is worth noting that now municipalities will be the ones to approve applications to create new MSMEs, instead of the Ministry of Economy, as had happened since the legalization of small private enterprises in 2021.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">This change, however, will not be officially implemented until March 2025. On the other hand, a national institute will also be created to supervise the private sector.<\/span><\/p>\n<blockquote class=\"wp-embedded-content\" data-secret=\"0bLeZ57hZK\"><p><a href=\"https:\/\/oncubanews.com\/en\/cuba\/economy\/msmes-complement-or-appendix-of-the-cuban-economy\/\">MSMEs, complement or appendix of the Cuban economy?<\/a><\/p><\/blockquote>\n<p><iframe loading=\"lazy\" class=\"wp-embedded-content\" sandbox=\"allow-scripts\" security=\"restricted\" style=\"position: absolute; visibility: hidden;\" title=\"&#8220;MSMEs, complement or appendix of the Cuban economy?&#8221; &#8212; OnCubaNews English\" src=\"https:\/\/oncubanews.com\/en\/cuba\/economy\/msmes-complement-or-appendix-of-the-cuban-economy\/embed\/#?secret=IeB9irWrKs#?secret=0bLeZ57hZK\" data-secret=\"0bLeZ57hZK\" width=\"500\" height=\"282\" frameborder=\"0\" marginwidth=\"0\" marginheight=\"0\" scrolling=\"no\"><\/iframe><\/p>\n<p><span style=\"font-weight: 400;\">According to official figures, the total number of non-state enterprises and cooperatives exceeds 11,000 and they employ approximately a quarter of the workforce on the island.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Another point that critics have pointed out is the obligation for partners of private MSMEs to be Cubans with effective residence \u2014 that is, who live more than half the year in the country or have proven ties to the island \u2014 or foreigners with permanent residence.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Academicians and independent experts have criticized this point, as they consider that it affects enterprises with partners with dual nationality and residence outside the country.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">The government, on the other hand, has stressed in recent months the importance of avoiding \u201cdistortions\u201d in its economy, mired in a deep crisis, and strengthening accountability in cases of tax evasion.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">The new regulations also include an update of the list of activities prohibited for private individuals on the island. These include activities related to mining, communications, the financial sector, health, energy \u2014 except for those related to renewable sources \u2014, defense and independent cultural and sports work, among others.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">The new regulations were added to last July\u2019s price cap on up to six products sold in the private sector, such as chicken and milk.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">The Cuban authorities have assured that they are not carrying out \u201ca crusade\u201d against the private sector, but, at the same time, they have criticized the actions of non-state entities, particularly in aspects such as the prices of their products and tax evasion.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">President Miguel D\u00edaz-Canel said at the National Assembly&#8217;s closing session last July that \u201cmany\u201d of the MSMEs \u201cdid not respond to the trust of the State.\u201d<\/span><\/p>\n<p><span style=\"font-weight: 400;\">The president criticized private businesses that have not had \u201cthe transparency that the population demands\u201d and announced that the government will act against \u201cthe lack of control, illegalities, tax evasion, speculation and fraud, wherever they come from.\u201d<\/span><\/p>\n<p><i><span style=\"font-weight:
