{"id":318573,"date":"2025-02-21T17:01:00","date_gmt":"2025-02-21T22:01:00","guid":{"rendered":"https:\/\/oncubanews.com\/en\/?p=318573"},"modified":"2025-02-24T17:49:46","modified_gmt":"2025-02-24T22:49:46","slug":"one-month-under-trump-the-reign-of-executive-orders","status":"publish","type":"post","link":"https:\/\/oncubanews.com\/en\/world\/usa\/one-month-under-trump-the-reign-of-executive-orders\/","title":{"rendered":"One month under Trump: the reign of executive orders"},"content":{"rendered":"<p><span style=\"font-weight: 400;\">An <\/span><a href=\"https:\/\/www.presidency.ucsb.edu\/statistics\/data\/executive-orders\" target=\"_blank\" rel=\"noopener\"><b>executive order<\/b><\/a><span style=\"font-weight: 400;\"> is an official document signed through which the president manages the operations of the Federal Government, orders a federal official or administrative agency to take action \u2015 or refrain from doing so.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Technically speaking, it is enforceable as long as it is within the president\u2019s constitutional authority. Congress has the power to override an executive order by passing legislation that invalidates it. The courts can also slow down or stop them.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Between January 20, when he took office, and February 12, Trump signed <\/span><a href=\"https:\/\/www.nafsa.org\/executive-and-regulatory-actions-trump2admin#president\" target=\"_blank\" rel=\"noopener\"><b>more than 65 executive orders<\/b><\/a><span style=\"font-weight: 400;\"> (42 of them on the first day, in front of a massive audience): the largest number that a president has launched in the first hundred days of his term, in more than forty years. Among the most important are the following:<\/span><\/p>\n<p><b>Immigration<\/b><\/p>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Stopping the arrival of refugees and suspending the U.S. Refugee Admissions Program as of January 27, 2025.<\/span><\/li>\n<\/ul>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Redefining birthright citizenship under the 14th Amendment. Under the proposed redefinition, a child born in the United States is not a citizen if: <strong>a)<\/strong> the mother does not have legal immigration status or is in the country legally but only temporarily; and, <strong>b)<\/strong> the father is not a U.S. citizen or legal permanent resident. The order prohibits U.S. agencies from issuing any document recognizing a child as a citizen or accepting any state document that recognizes citizenship.<\/span><\/li>\n<\/ul>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Prioritizing the continued construction of a \u201cwall\u201d and \u201cother barriers\u201d along the U.S.-Mexico border.<\/span><\/li>\n<\/ul>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Ending the Parole Program, which allows citizens of Cuba, Haiti, Nicaragua, and Venezuela to enter the United States.<\/span><\/li>\n<\/ul>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Prioritizing resettlement of South Africans of European descent through the U.S. refugee program, which Trump suspended on his first day in office. (He accused the South African government of discriminating against Afrikaners, who first settled there in the 17th century.)<\/span><\/li>\n<\/ul>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Requiring a review of the cases of all immigrants who are in the United States under Temporary Protected Status, with the intent to \u201censure that such designations are appropriately limited in scope\u201d and last the minimum time \u201cnecessary to meet the textual requirement\u201d of federal law.<\/span><\/li>\n<\/ul>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Ordering the Secretary of State and U.S. diplomats to impose sanctions on any nation unwilling to accept and facilitate the return of people the United States deports.<\/span><\/li>\n<\/ul>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Ordering the attorney general to deny federal money to <\/span><a href=\"https:\/\/cnnespanol.cnn.com\/2024\/12\/19\/estados-unidos\/que-es-ciudad-santuario-orix\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">sanctuary cities<\/span><\/a><span style=\"font-weight: 400;\"> that the administration deems to be interfering with the enforcement of federal immigration laws.<\/span><\/li>\n<\/ul>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Suspending the granting of federal money to non-governmental organizations \u201cthat support or provide services, directly or indirectly, to deportable or illegal aliens\u201d pending reviews and audits to identify any operations that may \u201cpromote or facilitate violations of our immigration laws.\u201d<\/span><\/li>\n<\/ul>\n<p><b>Domestic Policy<\/b><\/p>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Establishing the Department of Government Efficiency under the Executive Office of the President until July 4, 2026. This is the entity run by <\/span><a href=\"https:\/\/oncubanews.com\/en\/tag\/elon-musk\/\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">Elon Musk<\/span><\/a><span style=\"font-weight: 400;\">, the richest man in the world, charged with implementing cuts in federal programs and spending.<\/span><\/li>\n<\/ul>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Facilitating the firing of federal employees by reinstating an executive order from the first Trump administration, repealed under Biden. Provisions are added stating that federal employees and applicants \u201care not required to personally or politically support the current president,\u201d but must \u201cfaithfully implement the administration\u2019s policies,\u201d understanding that \u201cfailure to do so is grounds for dismissal.\u201d<\/span><\/li>\n<\/ul>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Repealing Biden\u2019s COVID-19 orders and directives.<\/span><\/li>\n<\/ul>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Eliminating Biden administration emissions standards that benefited electric vehicles. Reviewing any actions that could hinder domestic energy production.<\/span><\/li>\n<\/ul>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Commuting the sentences and granting pardons to hundreds of people convicted for their role in the <\/span><a href=\"https:\/\/oncubanews.com\/tag\/asalto-al-capitolio\/\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">January 6, 2021, attacks<\/span><\/a><span style=\"font-weight: 400;\"> on the U.S. Capitol.<\/span><\/li>\n<\/ul>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Ordering the attorney general to review investigative and enforcement actions by all agencies during Biden\u2019s term in office to identify what the president describes as \u201cthe weaponization of the federal government\u201d against his supporters. The directive identifies the Department of Justice, the Federal Trade Commission, the Securities and Exchange Commission, and the intelligence community. It requires a report to the president on the findings with recommended \u201ccorrective actions.\u201d<\/span><\/li>\n<\/ul>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Revoking the security clearances of 50 people Trump accuses of helping Biden\u2019s 2020 campaign. The list includes former top intelligence officials James Clapper, Michael Hayden, and Leon Panetta, along with Trump\u2019s former national security adviser John Bolton. And President Biden himself.<\/span><\/li>\n<\/ul>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Ordering the director of national intelligence and the director of the CIA to submit a report within 90 days with recommendations for additional \u201cdisciplinary measures\u201d and how to \u201cprevent the intelligence community or anyone working for or within it from inappropriately influencing national elections.\u201d<\/span><\/li>\n<\/ul>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Recognizing two genders at the federal level, eliminating diversity and inclusion initiatives. Ordering federal agencies to use the term \u201csex,\u201d not \u201cgender,\u201d and to ensure that federal personnel records and government-issued documents such as passports \u201caccurately reflect the sex of the holder.\u201d<\/span><\/li>\n<\/ul>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Ordering agencies to ensure that federal funds \u201cdo not promote gender ideology.\u201d<\/span><\/li>\n<\/ul>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Prohibiting federal funds from being used for sex reassignment health care in prisons and mandating \u201cprivacy in intimate spaces\u201d to ensure single-sex spaces are designated by sex and not gender identity.<\/span><\/li>\n<\/ul>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Withdrawing the United States from international sports programs that allow transgender women to participate. Ordering the Secretaries of State and Homeland Security to work to ban transgender athletes from entering the country.<\/span><\/li>\n<\/ul>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Defunding schools and other educational agencies that require COVID-19 vaccines for students and staff. Ordering Health and Human Services Secretary <\/span><a href=\"https:\/\/oncubanews.com\/en\/opinion\/robert-f-kennedy-jr-or-the-black-sheep-of-the-clan\/\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">Robert F. Kennedy Jr.<\/span><\/a><span style=\"font-weight: 400;\"> and the head of the Department of Education to create a plan to end federal funding to entities that do not comply.<\/span><\/li>\n<\/ul>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Ordering the Secretary of State to \u201cuse all appropriate and available measures\u201d to \u201censure that the International Olympic Committee adjusts its rules on women\u2019s sports participation.\u201d<\/span><\/li>\n<\/ul>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Restoring the name of Mount McKinley in Alaska. The change recognizes William McKinley, the 25th president of the United States, whom Trump has praised for his economic leadership and expansion of American territory during the late 19th century. In 2015, President Barack Obama renamed the mountain Denali, the name historically given to it by native tribes.<\/span><\/li>\n<\/ul>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Changing the name of the Gulf of Mexico to the \u201cGulf of America\u201d (United States). \u201cAmerica will reclaim its rightful place as the greatest, most powerful, and most respected nation on Earth by inspiring awe and admiration around the world,\u201d Trump said in his inaugural address. \u201cBefore long, we will change the name of the Gulf of Mexico to the Gulf of America.\u201d<\/span><\/li>\n<\/ul>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Declassifying records and documents on the assassinations of <\/span><a href=\"https:\/\/oncubanews.com\/en\/opinion\/columns\/in-plain-words\/john-f-kennedy-fidel-castro-and-the-story-of-what-could-have-been\/\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">President John F. Kennedy<\/span><\/a><span style=\"font-weight: 400;\">, Senator Robert F. Kennedy, and the Rev. Dr. Martin Luther King Jr.<\/span><\/li>\n<\/ul>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Ordering all executive agencies to adopt policies to reduce consumer prices.<\/span><\/li>\n<\/ul>\n<blockquote class=\"wp-embedded-content\" data-secret=\"jz7IMUrbTO\"><p><a href=\"https:\/\/oncubanews.com\/en\/opinion\/columns\/see-you-there\/donald-trump-another-united-states\/\">Donald Trump. Another United States&#8221; &#8212; OnCubaNews English\" src=\"https:\/\/oncubanews.com\/en\/opinion\/columns\/see-you-there\/donald-trump-another-united-states\/embed\/#?secret=18415L2QEF#?secret=jz7IMUrbTO\" data-secret=\"jz7IMUrbTO\" width=\"500\" height=\"282\" frameborder=\"0\" marginwidth=\"0\" marginheight=\"0\" scrolling=\"no\"><\/iframe><\/p>\n<p><b>Foreign Policy<\/b><\/p>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Exiting the Paris Agreement, arguing that it harms the U.S. economy.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Designating international cartels \u201cForeign Terrorist Organizations\u201d or \u201cSpecially Designated Global Terrorists.\u201d<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Redesignating Yemen\u2019s Houthis a terrorist organization.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Canceling Biden\u2019s sanctions on far-right Israeli groups and individuals accused of violence against Palestinians in the West Bank.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Ordering the Secretary of State to issue a guide to bring all State Department policy, programs, personnel, and operations in line with an \u201cAmerica First\u201d foreign policy.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Suspending all foreign development aid pending reviews of \u201cefficiencies and consistency\u201d with administration goals.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Withdrawing the United States from the World Health Organization (WHO). Ordering the White House Office of Management and Budget to halt future transfers of U.S. money to the WHO.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Applying a 25% tariff on imports from Canada, and a 10% levy on oil, natural gas, electricity, and other energy products. Mexican imports would face an additional 25% tax, and imports from China would face an additional 10% tariff.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Sanctioning officials at the International Criminal Court (<\/span><a href=\"https:\/\/oncubanews.com\/mundo\/ee-uu\/trump-contra-la-corte-penal-internacional-que-responde-con-un-llamado-a-sus-miembros\/\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">ICC<\/span><\/a><span style=\"font-weight: 400;\">), alleging that they have engaged in \u201cunlawful and baseless actions against the United States and our close ally Israel.\u201d Imposing financial sanctions and visa restrictions on ICC officials and their family members.<\/span><\/li>\n<\/ul>\n<p style=\"text-align: center;\"><strong>***<\/strong><\/p>\n<p><span style=\"font-weight: 400;\">This style of hyperventilating executive power has faced multiple responses from legal and civil society organizations.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">So far, judges have blocked Trump\u2019s orders to end birthright citizenship, freeze trillions of dollars in federal spending, and allow Elon Musk\u2019s \u201cgovernment efficiency\u201d effort to access government pay data. But dozens of lawsuits challenging other executive actions are pending.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">In early February, a federal judge in Rhode Island found that the Trump administration had continued to freeze federal funds, despite a temporary restraining order issued earlier by the same judge. In a five-page document, Judge John McConnell Jr. found that the administration had, in several instances, continued to \u201cimproperly freeze federal funds and refuse to resume the disbursement of those federal funds.\u201d<\/span><\/p>\n<p><span style=\"font-weight: 400;\">The ruling was a response to a lawsuit filed by the attorneys general of 22 states and the District of Columbia. In his decision, the judge ordered the administration to \u201cimmediately restore the frozen funds\u201d and \u201cimmediately end any pause in federal funding\u201d affecting the plaintiffs. A second federal judge spoke along similar lines. But they kept doing so.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Amid these circumstances, Vice President <\/span><a href=\"https:\/\/oncubanews.com\/mundo\/ee-uu\/los-jueces-no-pueden-controlar-el-poder-legitimo-del-ejecutivo-afirma-vicepresidente-de-eeuu\/\" target=\"_blank\" rel=\"noopener\"><b>JD Vance<\/b><\/a><span style=\"font-weight: 400;\"> declared that judges \u201ccannot check the legitimate power of the executive.\u201d And he went further in his advice to the president: \u201cFire all the mid-level bureaucrats, all the civil servants in the administrative state, and replace them with our people.\u201d<\/span><\/p>\n<p><span style=\"font-weight: 400;\">For their part, advocacy groups and state officials, not necessarily Democrats, argue that Trump poses a threat to the rule of law and the system of checks and balances that are supposed to restrict the powers of government.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">The issue raises the question of what judges can do if Trump defies them. They have no ability to take action against a president who enjoys broad immunity for official actions, especially after a <\/span><a href=\"https:\/\/oncubanews.com\/mundo\/ee-uu\/decision-de-la-corte-suprema-sobre-la-inmunidad-presidencial-es-un-terrible-flaco-favor-a-la-nacion-dice-biden\/\" target=\"_blank\" rel=\"noopener\"><b>Supreme Court ruling<\/b><\/a><span style=\"font-weight: 400;\"> last year.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">But they can use some tools against Trump officials and their government agencies. They can, for example, find officials or their lawyers guilty and fine them for contempt. And impose financial penalties for noncompliance. And, in extreme cases, jail them for that same contempt, among other possible measures.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">It is not simply that the new administration has violated a series of federal statutes and triggered an avalanche of legal challenges; some of Trump\u2019s top advisers (not just his vice president) have cast doubt on whether decisions on those lawsuits can constrain the president.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Everything points to a constitutional crisis, the result of the president\u2019s failure to comply with laws and judicial rulings. As a law professor at the University of California, Berkeley, put it: \u201cWe are in the midst of a constitutional crisis\u2026. There have been too many unconstitutional and illegal actions in the first 18 days of the Trump presidency. We have never seen anything like this.\u201d<\/span><\/p>\n<p><span style=\"font-weight: 400;\">One of Donald Trump\u2019s latest posts, reminiscent of Napoleon, is categorical and conclusive in this regard. He issued it on Presidents\u2019 Day, February 17: \u201cHe who saves his country does not violate any law&#8230;\u201d<\/span><\/p>\n","protected":false},"excerpt":{"rendered":"<p>Everything points
